This is not stopping in the construction industry either. Here, too, it is now difficult to find properly qualified staff.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is important to know that there are stricter framework conditions for temporary employment for companies in the construction industry. These must be observed at all costs. One can almost speak of a ban, because the <a href=\"https:\/\/personal-aus-osteuropa.de\/en\/portfolio\/labour-leasing-temporary-employment-temporary-work-personnel-leasing-eastern-europe\/\">what is temporary employment and how does it work?<\/a> is characterised by <a href=\"https:\/\/personal-aus-osteuropa.de\/en\/portfolio\/recruitment-agency-eastern-europe-recruitment-agency\/\">Personnel service provider<\/a> according to the <a href=\"https:\/\/zeitarbeit-international.de\/2024\/06\/25\/das-arbeitnehmerueberlassungsgesetz-inhalt-und-besonderheiten\/\">Temporary Employment Act <\/a>\u00a7 1b had already been prohibited in 1982.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To get around this or to counteract the shortage of skilled labour in the construction industry, there is the so-called \"colleague assistance\". This gives construction companies the opportunity to borrow workers from another construction company on a temporary basis. This allows companies to remain flexible.<\/span><\/p>\n<\/div>\n<div>\n<p><!-- \/wp:button --><\/p>\n<\/div>\n<p><!-- \/wp:buttons --><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7840ab09 tstk-btn-shape-round tstk-btn-color-globalcolor tstk-btn-style-flat elementor-widget elementor-widget-button\" data-id=\"7840ab09\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"button.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-button-wrapper\">\n\t\t\t\t\t<a class=\"elementor-button elementor-button-link elementor-size-sm\" href=\"https:\/\/personal-aus-osteuropa.de\/en\/portfolio\/temporary-work-temporary-employment-eastern-europe\/\">\n\t\t\t\t\t\t<span class=\"elementor-button-content-wrapper\">\n\t\t\t\t\t\t\t\t\t<span class=\"elementor-button-text\">More about temp work<\/span>\n\t\t\t\t\t<\/span>\n\t\t\t\t\t<\/a>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-22f0b5f9 elementor-widget elementor-widget-heading\" data-id=\"22f0b5f9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What is legally permitted in staff leasing?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f5ca65d elementor-widget elementor-widget-text-editor\" data-id=\"3f5ca65d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">It is only possible for two companies in the construction industry to provide temporary workers to each other. Incidentally, according to the Temporary Employment Act \u00a7 1b and 2b, this only applies to the areas of demolition, scaffolding, roofing and landscaping and gardening.\u00a0<\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0px;\">In plain language, this also means that only one construction company or scaffolder is allowed to hand over its specialists to another construction company or scaffolder.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, the lending company may only employ fewer than 50 workers. This includes all industrial employees, trainees, part-time employees and marginal employees.\u00a0<\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0px;\">The company owner is not counted here.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The size of the company is not relevant here.\u00a0<\/span><span style=\"letter-spacing: 0px;\">What is important, however, is that temporary employment requires that the hiring company can prevent short-time working and the risk of redundancies.\u00a0<\/span><span style=\"letter-spacing: 0px;\">There must also be a concrete and well-founded suspicion of this. In case of doubt, the lender must also provide proof of this.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-45d6cc6a elementor-widget elementor-widget-heading\" data-id=\"45d6cc6a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">How long can a company lend staff if it has fulfilled all legal requirements?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e9c55dc elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"6e9c55dc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"letter-spacing: 0px;\">Only if the company fulfils all legal requirements may it transfer the personnel to another company for a period of 12 months.\u00a0<\/span><span style=\"font-weight: 400;\">The hirer may also lend employees several times via a repeated assignment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is also permitted to lend out several employees at the same time.\u00a0<\/span><span style=\"letter-spacing: 0px;\">In this case, the hirer may not exceed a period of 12 months for each individual employee.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, there must be a concrete deployment plan.\u00a0<\/span><span style=\"letter-spacing: 0px;\">The competent authorities check whether the hirer fulfils the requirements of Section 1a of the A\u00dcG.\u00a0<\/span><span style=\"letter-spacing: 0px;\">The hirer is responsible for fulfilling all legal requirements in advance. Otherwise, he is guilty of unauthorised temporary employment.<\/span><span style=\"letter-spacing: 0px;\">\u00a0<\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0px;\">In summary, it can be said that two construction companies may lend employees to each other if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Both the hirer and the borrower are companies in the construction industry.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The lender is covered by the same framework and social security collective agreements for at least 3 years<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The hirer employs fewer than 50 employees<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Short-time work or redundancies can be avoided in the hirer's company by hiring out its employees<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The duration of 12 months for one employee at a time is not exceeded.<\/span><\/li>\n<\/ul>\n<p>Do you still have questions about temporary staffing in the construction industry or are you looking for temporary workers for construction?
